Under Part 4, Class B of Schedule 2 of the Town and Country Planning General Development Order 1988, helicopters are permitted to take off and land at temporary sites provided the site is not used for more than 28 days in any one calendar year. The operator must also have permission from the owner of the site. However, local planning authorities do have powers under Article 4 of the GDO to make a direction withdrawing these rights and requiring a planning application to be made for continued use of the site. If the direction is to remain in force for more than six months, approval from the Secretary of State for the Environment is required. If planning permission is refused or granted subject to conditions, compensation may be payable.
